Welcome to Daniel's Candles. By using our website (danielscandlesatl.com), placing an order, or otherwise interacting with us, you agree to these Terms of Service. If you don't agree, please don't use our site.
1. Eligibility
You must be at least 18 years old to place an order or create an account. Minors may use the site only with the involvement and consent of a parent or guardian.
2. Orders, Pricing & Acceptance
We make every effort to display accurate pricing and product information, but errors happen. We reserve the right to refuse, modify, or cancel any order — including after it has been placed — if a product is mispriced, out of stock, suspected of fraud, or for any other reason. If we cancel your order, we'll refund any payment in full.
All prices are in U.S. dollars and exclusive
of applicable taxes and shipping fees, which are calculated at checkout.
3. Payment
Payment is due in full at the time of order through the methods offered at checkout. By submitting payment information, you represent that you are authorized to use the payment method provided.
4. Shipping & Returns
Shipping timelines and costs are detailed in our Shipping Policy. Returns and refunds are governed by our Refund Policy.
5. Custom Orders
Custom-label, white-label, and branded orders are final sale once a digital proof has been approved. By submitting any logo, artwork, photograph, name, or other design for use on a custom candle, you represent that you own or have permission to use that material. You grant us a non-exclusive license to use it solely to produce your order. We are not responsible for any third-party claims of intellectual property infringement arising from materials you provide.
6. Wholesale Accounts
Wholesale and white-label accounts are subject to additional terms (including minimum order quantities, lead times, and pricing tiers) communicated at the time of account setup. Resale certificates may be required.
7. Intellectual Property
All content on this site — including the Daniel's Candles name, logo, product images, descriptions, scent profiles, and label designs — is owned by Daniel's Candles or used with permission. You may not reproduce, distribute, or use any of it without our written permission, except for personal, non-commercial use.
8. Reviews & User Content
If you submit a review, photo, comment, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt it for marketing and operational purposes. You represent that any content you submit is your own and does not violate any third-party rights.
9. Disclaimers
Our candles are intended for decorative and aromatic use only. They are not food, medicine, or therapeutic products. Always burn candles responsibly — trim the wick, place on a stable heat-resistant surface, never leave unattended, and keep away from children, pets, and flammable materials. We disclaim all warranties not expressly stated herein.
10. Limitation of Liability
To the fullest extent permitted by law, Daniel's Candles is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or the site. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.
11. Indemnification
You agree to indemnify and hold Daniel's Candles harmless from any claim, loss, or expense arising from your use of the site, your breach of these Terms, or any content or material you submit.
12. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Cobb County, Georgia, and you consent to the jurisdiction of those courts.
13. Changes
We may update these Terms at any time. The "Last updated" date will reflect the most recent revision. Continued use of the site after changes constitutes acceptance.
